Terms of Service

1. Service Description

kite ("the Service") is a web application that assists Instagram creators in replying to comments on their Instagram media. The Service connects to your Instagram Business account via the official Instagram Graph API, retrieves comments, generates AI-drafted reply suggestions, and posts replies on your behalf when you explicitly tap the send button.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) and have an Instagram Business account in good standing with Meta to use kite.

3. Your Responsibilities

  • You are the author of every reply sent through kite. AI drafts are suggestions; you are responsible for the final content you choose to send.
  • You must comply with Instagram's Community Guidelines and Meta's Platform Terms.
  • You must not use kite to send spam, harassment, hate speech, or unsolicited promotional content.
  • You must not attempt to reverse-engineer, scrape, or interfere with the Service.

4. Beta Status

kite is currently in private beta. The Service is provided "as is" without warranty of any kind. Features may change, be added, or be removed without notice. We may suspend or terminate access at our discretion during beta.

5. Pricing

Beta access is free of charge. Following general availability, paid plans will be introduced. Beta participants invited from the waitlist receive a perpetual ¥1,480 / month "Founding Member" rate per connected Instagram account.

6. Privacy

Your privacy is governed by our Privacy Policy, which forms part of these Terms.

7. Intellectual Property

kite (the application code, design, and brand) is the property of the operator. Replies, comments, and content you generate or post via Instagram remain yours and Meta's, governed by Meta's terms.

8. Termination

You may stop using kite at any time by signing out and disconnecting Instagram. We may terminate or suspend your access if you violate these Terms or Meta's Platform Terms. On termination, the deletion process described in our Data Deletion Instructions applies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

To the maximum extent permitted by law, the operator of kite is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of revenue, profits, data, or goodwill arising from your use of, or inability to use, the Service. Our total cumulative liability shall not exceed the amount you paid to us in the twelve months preceding the event, or JPY 5,000, whichever is greater.

11. Changes to These Terms

We may update these Terms. Material changes will be communicated via the Service or by email. Continued use of the Service after the change constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Japan, without regard to its conflict of laws principles. Any disputes arising in connection with these Terms will be submitted to the exclusive jurisdiction of the courts located in Tokyo, Japan.
